Terms of Service
Effective date: [[OWNER: effective date, e.g. July 1, 2026]]
These Terms are standard SaaS boilerplate provided as a starting point. They are not legal advice and must be reviewed by a licensed attorney and the business owner — including every [[OWNER: …]] field — before public launch.
These Terms of Service (“Terms”) form a binding agreement between you (“you” or “Subscriber”) and [[OWNER: legal company / entity name]] (“OtoResidENT”, “we”, “us”), the operator of the OtoResidENT study application available at otoresident.com and related domains (the “Service”). By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for medical students, residents, fellows, and clinicians using it for self-education. You are responsible for the accuracy of your registration information and for all activity under your account. Accounts are personal to you and may not be shared, resold, or used by more than one person.
2. Subscriptions, free trial & billing
The Service is offered on a paid subscription basis. Pricing, billing frequency, and plan features are described on our pricing page. Payments are processed by our third-party payment processor, Stripe; by subscribing you also agree to Stripe's applicable terms. We do not store full payment card numbers.
- Free trial. New subscribers may receive a 7-day free trial. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method is charged the then-current fee.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period (monthly or annually, as selected) at the then-current rate until you cancel. By subscribing you authorize us and Stripe to charge your payment method on a recurring basis.
- Price changes. We may change subscription fees. We will give you reasonable advance notice, and changes take effect at your next renewal.
- Taxes. Fees are exclusive of taxes; you are responsible for any applicable sales, use, VAT, or similar taxes.
3. Cancellation & refunds
You may cancel your subscription at any time from your account settings or by contacting support@otoresident.com. Cancellation stops future renewals; your access continues until the end of the current paid period.
Except where required by applicable law, subscription fees are non-refundable and we do not provide refunds or credits for partial billing periods or unused access. [[OWNER: confirm refund policy — e.g. a 14-day money-back guarantee — and update this section accordingly.]]
4. Acceptable use
You agree not to:
- scrape, bulk-download, or redistribute Service content;
- share account credentials or resell access to the Service;
- reverse engineer, attempt to extract underlying source material, or circumvent access controls, rate limits, or security features;
- use the AI tutor or any feature to make clinical decisions about identifiable patients;
- upload protected health information (PHI), proprietary copyrighted material, or unlawful content; or
- use the Service to build a competing product or train a competing model.
5. Intellectual property & content ownership
The Service, including its software, design, and the original synthesized prose we publish, is owned by [[OWNER: legal company / entity name]] and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal study during your subscription.
Cited source material remains the property of its respective open-access publishers and is used under their applicable licenses. We do not reproduce text from copyrighted textbooks. You retain ownership of content you create (such as notes or bookmarks); you grant us a license to host and process that content to operate the Service.
If you believe content infringes your copyright, contact our designated agent at support@otoresident.com with the information required under the DMCA. [[OWNER: register a DMCA agent and provide the agent's name and address.]]
6. Medical disclaimer
The Service is an educational study aid only. It is not medical advice and is not clinical decision support. Content may contain errors and may be out of date. Always verify against primary sources and institutional protocols and rely on supervising clinicians for patient care. See our full Medical Disclaimer, which is incorporated into these Terms.
7. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content is complete or current.
8. Limitation of liability
To the maximum extent permitted by law, [[OWNER: legal company / entity name]] and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold [[OWNER: legal company / entity name]] harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.
10. Suspension & termination
We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others or to the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and governing law) will survive.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app notice). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law & disputes
These Terms are governed by the laws of [[OWNER: governing-law state/country, e.g. State of Delaware, USA]], without regard to conflict- of-law rules. You agree that any dispute will be resolved in [[OWNER: courts/venue for disputes, e.g. courts located in Delaware]]. [[OWNER: confirm governing law, venue, and whether you require arbitration / a class-action waiver.]]
13. Contact
